so last night was pretty bad.
was driving in my local neighborhood wen i got pulled over.
so they made me blow into there stupid little fucking machine,
then the guy asked me to get out and walk in a straight line.
iv railed lines straighter but i thought i did a good job.
the cop looks at me and says why are you so nervous,
i said cos i hadnt been pulled over before.

he said my eyes looked bloodshot which is bs, cos cleareyes ftw.
so then he says he wants to take me to the hospital for a blood and urine test.
i knew they would find out from the blood test so after already lieing about my mj consumption
i told them id had like 3-4 billys bout 4 hours ago.
smart ass cop then goes on to tell me how long the "shit" (as he insisted on calling it) stays in your system.
it was his opinion that after 3-4 cones i should wait at least 8 hours b4 driving......lol haha good one mate.
at this stage im sweating fucking bullets.
they searched my car n off we go.
just to put some more shit on the cops one of em told me that buds shrink ya balls.
i know this is bullshit cos im not a spastic , and i cant emoticon exactly how i felt at the time, but basically i sat there laughing my ass off
while munching on a maxibon hidden in my pocket that the dumshits had missed
when searching me.
didnt get a lift back to my car after or nething.
so at 2:30 in the morning im stranded at the hospital.

well thats my story , plz dont pst saying you shouldnt have been under the influence of drugs while driving cos i wasnt even blazed nemore.

please if anyone could gimme some advice on laws in this in new south wales , australia.

iv never been in shit for this b4 so basically if someone could tell me

are the drug tests compulsary?
should i have refused to do it?
should i have told them to get fucked( like if they come to my house w/o warrant)?
is there anyway they can show i was stoned while driving and not just have it in my system from a previous occasion.
what happens from here in terms of fines , records etc.

any help would be greatly appreciated.

Rule number one: when it comes to driving on weed they have nothing. no roadside test, nothing. That is unless you admit that you smoked. I dont know how it is there but here it is treated as a dui or driving under the influence of alcohol. You nwill lose your liscence thats prob about it. 6 months liscense suspension here

yeh hopefully only like a traffic infringement lol but that seems doubtfull
in oz i know they have these fucking mobile drug vans which can drug test you
but the main issue is next time this happens should i refuse the test and then appeal that charge
or take the minor charge.

Hello! Sorry about your troubles.

You're best bet is to find something that they did wrong and get your test results thrown out of the equation. The search sounds "legal", being that you admitted to smoking. Anything they might have found can be used against you. I'm guessing they didn't find anything anyway.

Here is where I would start: you admitted to smoking, right? Why did they still need to test you at the hospitol? Then leave you there with no way back to your car, that's shitty and not neccassary since you admitted to smoking. I would also try going with the comments that they were making. If smoking is illegal and the cop told you to wait 8 hours before driving, that's like saying "fuck the law, wait it out." A cop should not be condoning illegal activity, or teasing you about your balls shrinking.

Being that you didn't get arrested and you got your car back, you might not get into any trouble. Just in case I would call an attorney or the police station and ask what the police procedures are for pulling someone over, searching their vehicle and taking them to get a blood test. Cops are human and they make mistakes. Find one and use it to save yourself.

There is no way to determine if you were high at the time of driving by a blood test..but there is no way to prove you weren't. Good Luck, Keep us posted!

im not familiar with australian laws, but lets say they are the same as in the states...

first, you can get a ticket for DWI, doesnt have to be alcohol, but if they can prove that you were intoxicated from something (they dont have to give proof of particular substance, just proof that you were fucked up. lol)

as for the blood test, well... your house, car, and body cannot be searched without a warrant unless they see something illegal in your car, house, or body (ie: joint behind the ear during a traffic stop)

so like i said above i dont know the australian legal system but i wouldnt have submitted to a blood test or a search of my vehicle (i think you said you did... cant remember now)

what happens from here in terms of fines , records etc. -- not 100% on this one, they cant tell with a blood test when you used (i think) but they might be able to use the fact your eyes were bloodshot and your nervousness (read as paranoia since its a common side effect of mj) so its possible they could get a judge to agree that with the evidence from the traffic stop and the evidence from the blood work that you were impared to drive. Depending on what they would charge you with, you could loose your liscense for 6 months and up (again, dont know australian laws) You could also be subjected to court ordered random drug tests along side a rehabilitation program for an extended period of time.

p.s. cops are not legally obligated to tell you the truth, ever. they can and will lie to intimidate you into a warrantless search or admitting a crime.

if you refused to do a road side drug test you can have your license automatically disqualified until your case goes to court.

When appearing you would want to have a pretty good story as the penalty's range from a few thousand dollar fine to unlimited license disqualification.

Its about 5 hours from last cone/joint that you are meant to wait so you dont get a positive reading.Some folk read clear earlier others longer.

I realize this is an older post however the road size drug tests will soon be as common as rbt's and other country's are looking closely at implementing similar tests.

I think the newer privatized mobile speed camera business and the reduction from 8 to 4km over the speed limit as acceptable will eat at more peoples hip pockets in fines and loss of work due to license disqualification.

Move out of NSW its the biggest police state in australia and in its bankruptcy your lives will only worsen

Here in the states you are ONLY required to identify yourself when asked by the police NOTHING more. When ever I am pulled over I roll down the window , (set your dome light to NOT come on) and keep both hands on the wheel until the officer asks for your drivers License. Hand him your License and do say nothing else. when he askes you questions pertaining to anything other than your identification inform him that you are not required to answer anything that could incriminate yourself ( I love the question, " do you know why I pulled you over? This question is designed to incriminate your self, SAY nothing , I tell them, "I could care less why you pulled me over.") . Always be polite and never look at the officer ALWAYS keep your eyes looking forward. If he asks you any questions just repeat your Name Address Drivers License number to him. If the officer asks you to stp out of your car do so but roll up your windows and lock the doors when you get out, (if they want to search your car ALWAYS ALWAYS ALWAYS respectfully decline.)

You don't have to do or say anything other than ID'ing yourself, The police are trained to ask you leading questions as part of ther investigation. you are not required to look at the officer (unless instructed to do so).

Do this EVERY time u get pulled over regardless if you are dirty or not.

Now keep in mind by doing this the officer will fuck with you, don't let him push your buttons. I love it when the cops get pissed, they really start making mistakes violating rights and what not. If you get good at it you can use the law in your favor to goad the cop to get mad. (just remember DON't get mad you make mistakes when angry, and so do cops )

It really is fun to mind fuck cops but just remember if you do this your 10 minute trafic stop WILL turn into at least an hour . Just know your rights and follow them to the letter don't give them anything you are not required to. If the cop says you are required then ask him for the RCW stating as such.

Ask for a Diversion. That way you wont get a record, and will bascially get away with it this time.
They can test you anytime they want, and if they suspect your stoned then you have to get a blood test. The first test is not admissable in court, the blood test is.
yes you could have refused, and you would have spent the night in lock up, had no license for 2 years and been put on their shit list.
